That whole paragraph went 'whooosh" straight over the top of my head.

Can you please translate Matt, I'm from the Midlands :)

What this means is any event organiser or individual failes to check miss or advise incorrectly checks of safety equipment in an arranged gathering could potentialy be in trouble in a civil law court if something whent wrong or an individual took advantage.......im not sure if HASWA would cover this but it could come in to play i if it applied.

Im NEBOSH certified so know a little bit about H+S law.

Basicly if someone sais u must have bla bla bla and then fails to reasonably practicably check then that person who has controling mind by stipulating has failed to to ensure the safety of those he has controling mind over so thing manager over staff then he is liable if proven he knew and ignored. Law is complicated .....and im no expert. Bad example but u get the jist

I would have thought this discussion was highly relevant and on topic?

May I put in my 2p :| and maybe put things into perspective :?

The thread was created to get my fellow boaters on here to think about where and when they might go boating next year and hopefully invite me to join them because I particularly like the 'company' :D
I also enjoy visiting various areas of the UK, enjoying the surroundings but have little or no knowledge of new areas so it saves me time to have local knowledge finding somewhere to launch, stay etc.

Someone mentioned a barbecue so I'll use this as an example .........Let's imagine there's a Barbecues'r'us-forum.com

Paul
I really enjoy barbecues in the countryside and wondered if anyone on here would like to join me and have any suggestions where there are good places to visit and barbecue :?:
I'll be using my own barbecue, cooking on it myself for myself and family ;-)
Maybe we'll go for a walk or bring a ball game that we can all enjoy depending on the weather :| but we'll decide on the day if anyone joins me :Confused

Martin, Chris and Matt respond and we all decide to go to the New Forest for the day :star

We all fire up our own barbecues and cook our own food, once we're all happy the food's cooked we all sit down to eat together :D

Later during our walk together Martin starts throwing up ..... it appears he's got food poisoning from not cooking his chicken long enough :(
We all decide to turn round and walk back to the barbecue location and whilst walking back Chris trips over and falls breaking his leg
We pick Chris up, carry him to Matt's car to take Chris to the local hospital and during the hasty trip Matt breaks the speed limit and gets caught by a Gatso camera :-x

How unlucky can you get :thud ........... so are folks saying that Paul shouldn't have asked the question via the forum and obviously Barbecues'r'us-forum.com are to blame for allowing the question/thread :stop ......... Martin, Chris and Matt sue Barbecues'r'us-forum.com

This barbecue example is how I view this boating thread ...... no money is changing hands, sponsorship to raise money, no rules, laws etc, etc ........ just an exchange of ideas where to go boating with my fellow boating enthusiasts via the forum ....... the forum is my way of communication with my mates/friends/fellow boating enthusiasts ....... so how is the forum held responsible :scratch :Confused

I've seen this type of topic 'rage' on two other platforms of media, with folks making many claims and making it bigger than it is  and TBH a bloody argument with fatalities in the fall-out :stop :thud
I consulted and let a close friend of mine very high up in H&S view/read those debates at the time and he rolled his eyes and laughed saying that at our level it's perfectly fine, however once employment or money gets involved it's a different matter :!:
Note, the definition of 'money' means paying to take part in an event but excludes paying 'money' for your personal accommodation :!:

There's my 2p
:cheers
